This is the web site of Hercules Tire & Rubber ("Hercules"). Hercules takes your privacy seriously. Please read the following to learn more about our privacy policy.

    • A. General. This policy covers how Hercules treats personal information that Hercules collects and receives, including information related to your past use of the Hercules website, its products and services. Personal information is information about you that is personally identifiable like your name, address, e-mail address, or phone number, and that is not otherwise publicly available.
    • B. Companies Not Controlled. This policy does not apply to the practices of companies that Hercules does not own or control, or to people that Hercules does not employ or manage.
    • A. General.
      • 1. Collection. We collect the domain name and e-mail address (where possible) of visitors to our Web page, the e-mail addresses of those who post messages to our bulletin board, the e-mail addresses of those who communicate with us via e-mail, the e-mail addresses of those who make postings to our chat areas, aggregate information on what pages consumers access or visit, user-specific information on what pages consumers access or visit, information volunteered by the consumer, such as survey information and/or site registrations, payment information (e.g., credit card number and billing address. Hercules may combine information about you that we have with information we obtain from business partners or other companies
      • 2. Information Sought. When you make a purchase, complete a survey or the like, we may ask for information such as your name, e-mail address, birth date, gender, zip code, occupation, school, industry, and personal interests. For some financial products and services we may also ask for your address, Social Security number, and information about your financial accounts or assets. Once you provide such information, you are not anonymous to us.
      • 3. Right to refrain from giving information. You have right to refrain from giving us certain information, but then you might not be able to take advantage of all of our features. We use the information that you provide for to enhance the service, such as responding to your requests. However, you may not mask your identity by providing false or misleading information. Hercules automatically receives and records information on our server logs from your browser, including your IP address, Hercules cookie information, and the page you request. However, disabling the acceptance of cookies will not allow you to take full advantage of some of the best and most advanced features that we have to offer, and we recommend that you leave them turned on.     • B. Information Sharing and Disclosure
      • 1. Sharing of Personal Information. Hercules does not rent, sell, or share personal information about you with other people or nonaffiliated companies except to provide products or services you have requested, when we have your permission, or under the following circumstances:
        • (a) We provide the information to trusted partners who work on behalf of or with Hercules under confidentiality agreements. These companies may use your personal information to help Hercules communicate with you about offers from Hercules and our marketing partners. However, these companies do not have any independent right to share this information.
        • (b) We respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims;
        • (c) We believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Hercules' terms of use, or as otherwise required by law; and
        • (d) We transfer information about you if Hercules is acquired by or merged with another company. In this event, Hercules will provide notice before such information about you is transferred and becomes subject to a different privacy policy.
      • 2. Ad Targeting. Hercules displays targeted advertisements based on personal information. Advertisers (including ad serving companies) may assume that people who interact with, view, or click on targeted ads meet the targeting criteria - for example, women ages 18-24 from a particular geographic area.
        • (a) Hercules does not provide any personal information to the advertiser when you interact with or view a targeted ad. However, by interacting with or viewing an ad you are consenting to the possibility that the advertiser will make the assumption that you meet the targeting criteria used to display the ad.
        • (b) Hercules advertisers include financial service providers (such as banks, insurance agents, stock brokers and mortgage lenders) and non-financial companies (such as stores, airlines, and software companies).
  • 3. Children Under Age 13
    It is Hercules' firm policy to not knowingly collect, solicit, retain or display any personal information or material from anyone under the age of 13. No one under age 13 may provide any personal information to Hercules. In the event that we learn that we have collected personal information from a child under age 13, we will promptly delete that information.
